Terms of Service

The short version

CrunchTrivia is a free tool for running trivia in a room. You need an account to host a game; players only need the code. The questions you write stay yours — we store them so your players can see them.

It costs nothing and it comes with no promises: we don’t guarantee it will be online, and we don’t guarantee your old games will still be there. Don’t use it to harass anyone or to do anything illegal.

This summary is here to be read. It is not the agreement — the numbered sections below are.

01Who we are, and what you’re agreeing to

CrunchTrivia is operated by Foxbit Software LTD (“we”, “us”, “our”). These Terms of Service form an agreement between you and Foxbit Software LTD covering your use of crunchtrivia.com and everything on it (the “Service”).

By creating an account, joining a game, or otherwise using the Service, you agree to these terms. If you don’t agree with them, don’t use the Service.

Our Privacy Policy explains what we do with personal information and forms part of this agreement.

02Who may use the Service

There are two kinds of people here. Hosts create and run games and need an account. Players join a host’s game with a code and need nothing but a browser.

  • You must be at least 13 years old to create a host account. If you are under the age of majority where you live, you may only host with the involvement of a parent, guardian, or teacher who accepts these terms on your behalf.
  • Players are not required to have an account and are not required to give us their name, email address, or anything else beyond a display name they choose.
  • If you are hosting a game for people under 13 — a classroom, a youth group — you are responsible for the room. Tell your players to use a first name or a nickname rather than their full name, and see the section on children in our Privacy Policy.
  • You may not use the Service if we have previously terminated your access, or if doing so would break a law that applies to you.

03Your account

You are responsible for your account and for everything done through it. Keep your password to yourself, use one you don’t use elsewhere, and tell us through the support form if you think someone else has got into it.

Give us an email address you can actually receive mail at. It is the only way to reset your password, and we cannot restore access to an account whose email address you no longer control.

04How the Service works, and what that means for you

This is worth understanding before you rely on a result. CrunchTrivia runs entirely in the browser. There is no server of ours in the middle of a game.

  • Grading happens in the host’s browser. When you mark an answer right or wrong, your own device writes that result to the database. Our database rules make sure only the host of a game can write its scores — but the host is the authority on what those scores are, not us.
  • We do not arbitrate results. If there’s a dispute about whether an answer counted, it is between the players and their host. We have no way to verify what happened in a room, and we won’t try.
  • Answers are not visible to players. The Service is built so that a question’s answer is never sent to a player’s device before the host reveals it. We think this is important and we’ve designed for it, but we don’t warrant that it is unbreakable.
  • Timers are enforced by the database clock, not by the countdown on anyone’s screen, so a player with a wrong clock isn’t locked out and a player with a clever clock isn’t let in.

05Your content

The questions, answers, titles, and anything else you put into the Service are yours (“Your Content”). We claim no ownership of them.

So that the Service can actually work, you grant us a worldwide, non-exclusive, royalty-free licence to store, copy, transmit, and display Your Content — but only for the purpose of operating the Service for you and showing your games to the players you invite. That licence ends when you delete the content, other than for backups that age out in the ordinary course.

You are responsible for what you put in. By using the Service you confirm that Your Content is yours to use and doesn’t infringe anyone else’s rights. We don’t review, edit, or endorse anything a host writes.

If you believe content on the Service infringes your copyright, tell us through the support form with enough detail to identify the work and the game, and we will act on it.

06Acceptable use

You agree not to use the Service to:

  • harass, threaten, defame, or single out any person, including through the content of questions or a chosen display name;
  • post content that is unlawful, hateful, or sexually explicit, or that you know to be false in a way that would harm someone;
  • break into, probe, or interfere with the Service, other people’s games, or the accounts of others — including attempting to read a question’s answer before the host reveals it, or to write scores for a game you don’t host;
  • automate access at a scale that degrades the Service for other people, or scrape it systematically;
  • resell, sublicense, or present the Service as your own product; or
  • break any law that applies to you.

Security research is welcome. If you find a way to read an answer you shouldn’t, or to write to a game you don’t host, please report it through the support form before doing anything else with it, and don’t access or modify anyone else’s data while you look into it.

07Playing a game

Joining a game means the host of that game can see the display name you chose, the answers you submit, and your score, and can show all of it on a screen in front of the room. That is the point of the product. Choose a display name you’re comfortable having on a projector.

Hosts choose the questions. We are not responsible for a host’s questions, their grading, or how they run their room.

08Availability, changes, and your data

The Service is free, and it is offered as it is. We may change it, add to it, take features away, or stop offering it entirely, at any time and without notice.

  • We do not promise uptime. Don’t build a paid event around it without a fallback.
  • We do not promise your data will survive. Keep your own copy of any question set that matters to you.
  • We may impose limits on the size or number of games in order to stay within the free infrastructure the Service runs on.

09Suspension and termination

You can stop using the Service whenever you like, and you can delete your games from your host dashboard.

We may suspend or terminate your access, with or without notice, if you break these terms, if your use puts the Service or other users at risk, or if we are required to. Where it is reasonable to do so, we’ll tell you why.

Sections that by their nature should survive the end of this agreement — content licences already granted for backups, disclaimers, liability limits, indemnity, and governing law — survive it.

10Services we depend on

The Service runs on Google Firebase, and the support form uses Cloudflare Turnstile and Crunchforms. Your use of the Service means your data passes through those providers. They are listed, with what each one sees, in our Privacy Policy.

11Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, Foxbit Software LTD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

Some jurisdictions do not allow the exclusion of certain warranties. If you are in one of them, this section applies to you only as far as the law allows, and nothing here limits any rights you have that cannot be waived — including under the Consumer Protection Act of Manitoba or equivalent consumer legislation where you live.

12Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Foxbit Software LTD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE — WHETHER OR NOT WE WERE ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO ONE HUNDRED CANADIAN DOLLARS (CAD $100). The Service is free; this limit reflects that.

Nothing in these terms excludes liability for fraud, for fraudulent misrepresentation, or for anything else that cannot be excluded by law.

13Indemnity

You agree to indemnify and hold harmless Foxbit Software LTD and its directors, officers, and employees from any claim, demand, loss, or expense (including reasonable legal fees) arising out of Your Content, your use of the Service, or your breach of these terms.

14Changes to these terms

We may update these terms. When we do, we’ll change the “last updated” date at the top of this page, and if the change is significant we’ll make a reasonable effort to tell hosts about it before it takes effect.

Continuing to use the Service after a change means you accept the updated terms. If you don’t accept them, stop using the Service and delete your account.

15Governing law

These terms are governed by the laws of the Province of Manitoba, Canada, without regard to its conflict of laws rules. You and Foxbit Software LTD agree to the exclusive jurisdiction of the courts of Manitoba for any dispute arising out of them.

If you are a consumer resident somewhere with mandatory local consumer protections, this section does not deprive you of the protection of those rules or of the right to bring proceedings where you live.

If any part of these terms is found unenforceable, the rest stays in force.
